Checklist Of Documents (And Information) Needed

Company (Job Related) Information:
  • The company’s full (legal) name;
  • The year the company was established;
  • The company’s IRS Tax or Employer Identification Number;
  • Whether the company is publicly or privately held:

    • If publicly held, please supply a copy of the company's most recent Annual Report and a copy of the company's latest Securities and Exchange Commission Form 10-K. Please include the 10-K's Exhibit 21 or 22 -- whichever one lists "Subsidiaries of the Registrant."
    • If privately held, a description of the precise chain of ownership that links the foreign nationals current employer abroad and your company. Please depict all companies in the chain including holding companies and provide ownership percentages at each level.
  • A company or business "backgrounder" or other similar informational or promotional materials, brochures, literature, articles and such about the company's business;
  • The precise corporate name of the foreign national's current employer and the foreign national's current work address abroad; and
  • A description of the precise chain of ownership that links the foreign national's current employer abroad and the U.S. company. Please depict all companies in the chain (including holding companies) and provide ownership percentages.
  • Please also advise as to what evidence is available to prove the ownership, for example, stock certificates.
  • The company’s latest gross annual income (or gross revenue) and net income (if available) of the U.S. company;
  • The company’s current number of employees (preferably worldwide).
  • Information about the compensation package offered to the foreign national including annualized salary in U.S. Dollars;
  • A copy of the company’s offer letter, if applicable;
L-1A-Managerial Capacity Basis:
  • The foreign national’s proposed job or position title in the U.S.;
  • A detailed description of the proposed duties that the foreign national will perform in the U.S. A pre-printed job description maintained by the company regarding the offered U.S. position is acceptable.  If no pre-printed job description exists, please provide a list of the 10 or so job duties that the foreign national will most regularly perform in this capacity.  All supervisory, managerial and oversight activities should be clearly indicated];
  • A job or organizational chart for the U.S. position.

    To qualify for an L-1A Visa, the company must show that the U.S. position is Managerial.  Please provide us with a chart (handwritten charts are fine) showing the foreign national’s prospective U.S. position in the context of the company’s organization.  The chart should indicate the job titles of all company employees who will directly or indirectly report to the foreign national.  If the foreign national will supervise only one level of employees, please indicate on the chart the educational credentials (i.e., degree/major) that these employees possess.]  If no employees will be regularly supervised, please provide a detailed description/diagram of the functions and/or projects that the foreign national will manage and any employees that the foreign national will direct on a "dotted line" basis;
  • The foreign national’s current job or position title with the organization abroad;

    If the employee is not currently working for your company abroad but previously worked for your organization for one full year within the past three years, please provide the requested information for the transferee’s former employment abroad with your organization.
  • A detailed description of the foreign national’s current duties with the company abroad.  Please follow the same format as with the U.S. job description (see above);
  • Job or organizational chart for the foreign national’s position abroad.  Please follow same format as with U.S. job chart (see above); and
  • A brief explanation of the reason why the foreign national is being transferred to the U.S.
