Checklist Employer's E-2 Petition For Foreign National

Employer Information:

  • Employer's full (legal) name;
  • Type of business enterprise (Corporation, Partnership, Branch/Liaison Office, Privately Owned, Joint Venture, Subsidiary, Other);
  • Date of Employer's incorporation or establishment in U.S.;
  • Copy of Employer's Articles of Incorporation, Partnership Agreement, or other documentation formally recognizing date of establishment;
  • Stock certificates of Employer, if applicable;
  • Nature of Employer's business;
  • Name and address of Employer's foreign parent (if applicable);
  • Name, nationality, and percentage of ownership of each person or entity that is owner of Employer, and for each person indicate his/her immigration status and country of residence;
  • Audited Financial Statements or Annual Report for most recently ended fiscal year;
  • Amounts Employer has invested in U.S. enterprise/branch offices/subsidiaries in most recently ended fiscal year, broken down in terms of cash, inventory, equipment, premises, and "other";
  • IRS Tax ID Number;
  • Whether Employer is publicly or privately held. (If the former, please supply an Annual Report);
  • A company or business "backgrounder" or other informational materials, brochures, literature, articles, etc. about Employer or Employer's business;
  • Latest gross annual income (or revenue) and net annual income figures (net -- if available);
  • List of current employees: For each employee, please indicate job title, what country he/she is from and his/her current immigration status, and if the employee is a Manager or Executive, please indicate what type of Visa he/she holds, where the Visa was issued and on what date;
  • Estimated number of employees that will be added in next fiscal year, with job title and country. If from Foreign National's home country, please indicate number of expected employees that will hold E, H, or L Nonimmigrant Visas;
  • Current job or position title of Foreign National and list of duties;
  • Number of years Foreign National has been with Employer;
  • Highest level of education attained by Foreign National;
  • Information about the duties that Foreign National will perform (a job description would be ideal, but a series of "bullets" will be fine);
  • Information about the minimum entry requirements (education, experience, etc.) necessary for this position.
  • The salary Employer proposes to pay Foreign National, and any other compensation offered;
  • The name of the person in the U.S. that Foreign National will replace, as well as the type of Visa held by this person and the date and place where the Visa was listed;
  • The name and direct dial telephone number and e-mail address of Foreign National's immediate supervisor;
  • A photocopy of Employer's offer letter; and
